Daily apologises over cement fetish case photo mix-up

A daily newspaper has apologised to a woman it confused for someone of the same name who was involved in an attack on a man with a cement fetish.

The Daily Record has said sorry to Sharon Kerr after publishing a photograph of her in relation to a court case involving a woman who shared her name.

A story by the Glasgow-based Record reported that a man had been ambushed and attacked with a machete and a knife after being lured to the home of another woman called Sharon Kerr for “seedy sex – apparently involving cement”.

Ms Kerr complained to the Independent Press Standards Organisation that the Record breached Clause 1 (Accuracy) and Clause 2 (Privacy) of the Editors’ Code of Practice in a story headlined ‘Cement fetishist slashed in flat torture ordeal’.

She said she had been misidentified, she was not involved in the incident, that she had not faced any court proceedings in relation to it and that her photograph had been published in error.

The Record apologised for the distress caused to the complainant and said that the photograph had been taken from her Facebook profile in error

The newspaper said the reporter, who had been present in court, had made a genuine mistake in confirming the individual’s identity, adding that the image had been deleted from its records and marked their cuttings library with a warning.

Following IPSO’s intervention the matter was settled privately between the parties, and no adjudication was made on whether there was a breach of Code.

    Desker’s right. Even with concrete proof that you’ve got the correct image, the CDPA 1988 is waiting in the wings to bite your ass.
